Fraud Update

U.S. DOT Considers DBE Rule Changes

The changes being considered cover the following areas: (1) credit for supplies (including materials and equipment) obtained by DBEs from non-DBE sources, (2) contract unbundling, (3) certification applications and net worth statements, (4) program oversight by states, (5) interstate certification, and (6) terminations for convenience and substitutions.
Credit for supplies. Currently, primes receive 100% credit if the suppliers are DBEs; if not, the credit is 60% toward the DBE goal. U.S. DOT is looking at four options: (1) leave the rule as is; (2) leave the rule as is, but allow exceptions, e.g., prime is also a supplier; (3) allow 100% credit regardless of who the DBE gets the supplies from; and (4) allow no credit regardless of who the DBE gets the supplies from-which U.S. DOT says will require goals to be lowered.
Contract unbundling. This refers to taking large contracts and breaking them up into smaller contracts, which U.S. DOT believes may make it easier for DBEs to participate.
Certification applications and net worth statements. Here U.S. DOT is looking for suggestions that will either provide a clearer picture of the applicant or expedite the certification process. MTBMA notes that the certification process should include verification that the applicant possesses all third-party certifications required by SHA or other owners to perform the work for which the certification is sought. As a recent example, a DBE bridge painter certified by MDOT did not possess the SSPC certifications required by SHA for bridge painters.
Program oversight by states. Here, the issue is whether SHA should take a more active role in monitoring the DBE program rather than leaving fraud detection to other agencies.
Interstate certification. This would, in effect, broaden to the entire U.S. the reciprocity arrangements Maryland has with Pennsylvania and other states.
Terminations for convenience. The terminations referred to here are by the contractor. According to U.S. DOT, if a contractor terminates DBE A and replaces it with DBE B, that is okay. It would not be okay for the prime to terminate A and then do the work with its own forces. In Maryland, this is not an issue, because once a DBE is named on the DBE forms submitted with the bid, you have to go through hell and high water to make a change-no matter how compelling the facts.
